1) Joining the Program

By applying to the Elsewheria Tours Affiliate Program (the “Program”), you agree to these Affiliate Terms & Conditions (the “Terms”). Enrollment is subject to review.

Application review time: 1-3 business days.
Acceptance: We’ll email you if approved. We may reject or remove any application at our discretion.
One account: One affiliate account per individual or business unless we approve otherwise.
Country eligibility: No restrictions.

2) Your Responsibilities

Use ethical marketing practices and comply with all laws and platform rules.

Truthful promotion: Don’t make false, misleading, or unsubstantiated claims.
Disclosures: Clear affiliate disclosures are required (e.g., “I may earn a commission…”).
Compliance: Follow advertising, privacy, and email laws (e.g., CAN‑SPAM/UK PECR/GDPR, platform policies).
Email marketing: Only email users who consented; include working unsubscribe links.
Social & content: Don’t impersonate Elsewheria or represent yourself as our employee or official channel.
Domains & usernames: Don’t register domains, social handles, or apps that include our brand or confusingly similar variations without written permission: Prohibited terms: “Elsewheria”, “Elsewheria Tours” and misspellings.

3) Tracking & Attribution

We track referrals via your unique tracking links.

Attribution model: Last‑click wins
Cookie window: 30 days from the last valid click.
Cross‑device tracking: Not enabled.
Direct linking to our site via ads: Allowed
Self‑referrals: Not allowed.
Coupon attribution: Commission applies only when using authorised codes we’ve issued to you. Unlisted/third‑party coupons don’t qualify.

Note: If a customer uses multiple affiliate links, the Last‑click wins attribution model decides which affiliate earns the commission.

4) Commissions & Payments

Commission rate: 5% of net booking value
Net booking value definition: Subtotal excluding VAT/taxes, fees, insurance, third‑party charges, gift cards, shipping, and any discounts or cashback
Non‑commissionable items: Taxes, fees, insurance add‑ons, third‑party excursions, gift cards
Eligibility conditions:
- Booking must be paid in full by the customer
- Booking must be non-refundable under Elsewheria’s cancellation policy
- Booking must be tracked via a valid affiliate link and correctly attributed
Locking/validation period: Commissions become eligible for payout 30 days after the guest has completed their trip, provided the booking was made via a valid affiliate link and is not subject to refund or chargeback.
Payment schedule: Monthly on the 30th for validated commissions earned in the prior period
Minimum payout threshold: $50
Payment method & currency: PayPal, paid in USD. Any payment fees are covered by the affiliate

Refunds, Chargebacks & Cancellations

We only pay commissions on valid, completed, and fully paid bookings/orders.

If a booking/order is refunded, cancelled, charged back, fraudulent, duplicated, not paid, no‑showed, or not fulfilled, the related commission will be removed from the affiliate’s pending balance and will not be eligible for payout.
Partial refunds lead to proportionate commission reductions.
We may withhold or adjust commissions for suspected abuse, non‑compliant traffic, or reporting errors.

5) Creative Assets & Brand Use

You may use our approved logos, banners, product images, and copy. Please contact us if you would like access to these.
Custom creatives or edits require prior written approval: wthatton@gmail.com.
Don’t alter our brand in a misleading way, and don’t suggest affiliation or endorsement beyond the Program.

6) Traffic Quality & Prohibited Practices

To protect customers and affiliates, the following are not allowed:

Spam of any kind (email, comments, messages), cookie stuffing, forced clicks, adware, malware, spyware, or toolbar placements.
Misleading UX (fake scarcity, fake reviews, misleading countdowns), or cloaked/doorway pages.
PPC bidding on our brand terms (and misspellings) or using our brand in ad copy without permission.
Direct linking to our site via paid search is allowed only if you do not bid on branded keywords.
Resale of leads, incentivized clicks without value (e.g., pay‑to‑click), or any illegal content.

7) Coupons, Deals & Price Comparisons

Use only coupons or promo codes we have issued to you.
“Coupon scraping/poaching” from other sites is not eligible for commission.
If price comparisons are used, they must be accurate, time‑stamped, and cite sources.

8) Privacy & Data

You must comply with applicable privacy and data regulations (e.g., GDPR/UK GDPR).
You are responsible for your audience’s consent and disclosures.
Don’t share any personal data of your users with us unless necessary and authorized.
We may share aggregated performance data with you to help optimize your campaigns.

9) Intellectual Property

All rights in our site, products, content, and marks remain with Elsewheria Ventures. We grant you a limited, revocable, non‑exclusive license to use our marks/creatives solely to promote the Program as permitted by these Terms.

10) Taxes

You are responsible for all taxes, duties, and filings related to your commissions. We may require certain tax forms before paying commissions such as Non‑UK: W‑8BEN/W‑9 if requested.

11) Term & Termination

These Terms begin on the Effective Date and continue until terminated.
Either party may terminate at any time for convenience with 30 days notice.
We may suspend or terminate immediately for breach, suspected fraud, or prohibited practices.
On termination, you must remove our links/creatives promptly. Valid, non‑breach commissions accrued before termination will be paid on the next cycle; commissions tied to breach or invalid activity will be void.

12) Changes to the Program or Terms

We may update the Program or these Terms from time to time. We will post changes at on this page and, where material, notify you via email/affiliate dashboard. Continued participation after the Effective Date of changes means you accept them.

13) Limitation of Liability & Indemnity

We provide the Program “as is.” We are not liable for indirect, incidental, special, consequential, or punitive damages. Our total liability under these Terms will not exceed the total commissions paid to you in the 3 months preceding the claim.
You agree to indemnify and hold us harmless from claims arising from your websites, ads, emails, content, or breach of these Terms.

14) Governing Law & Disputes

These Terms are governed by the laws of the United States and the courts of Wyoming, USA have exclusive jurisdiction.

15) Entire Agreement & Order of Precedence

These Terms, together with any documented policies we publish for the Program, constitute the entire agreement regarding the Program and supersede prior discussions. If there’s a conflict, these Terms prevail unless a signed addendum says otherwise.
