1. Booking and Payment

1.1 To reserve a place on an Elsewheria tour, the client must complete the booking form and pay the required deposit either via bank transfer or by completing a checkout via our website.

1.2 Full payment must be made by the due date specified in the booking confirmation. Failure to do so may result in cancellation of the booking.

1.3 Bookings are not considered confirmed until the deposit stated has been paid and received.

1.4. Every booking includes a non‑refundable commitment/ deposit of $500 (or $800 for Tonga), whether the guest pays a deposit or pays in full.

However, if the client cancels more than 90 days before the start of the trip, the full non-refundable amount/ deposit may be applied as credit toward a future Elsewheria trip (one-time transfer only and must be used within 12 months).

1.5 In cases where extraordinary, non-recoverable costs (such as flights, permits, or visas) are involved, these costs are never refundable by us, regardless of notice.

1.6 Final payment is due at least 90 days before the trip start date, unless otherwise stated. Bookings made within 90 days of departure require full payment at the time of booking.

1.7 If the client cancels:

      • 90+ days before the trip: Full refund minus the non-refundable amount/ deposit.
      • 51-90 days before the trip: 50 percent refund of total payment (excluding the non-refundable amount/ deposit).
      • 31-50 days before the trip: 75 percent refund of total payment (excluding the non-refundable amount/ deposit).
      • Less than 30 days or fewer before the trip: No refund. We highly recommend purchasing travel insurance that covers cancellations, delays, and medical emergencies.

    2. Cancellations and Refunds

    2.1 Elsewheria reserves the right to cancel, postpone, or offer a credit for a tour due to unforeseen events outside of our control, depending on the circumstances.

    Unforeseen events outside of our control will be understood as situations where, in the judgment of Elsewheria, based on its experience, it is determined that the trip could pose a danger to the safety and integrity of the travelers. Many of the destinations Elsewheria visits are prone to war, natural disasters, political unrest, and other high-risk conditions. The client assumes this risk and waives any right to claim compensation from Elsewheria in these cases.

    2.2 Trip cancellation by organizer will be 60 days before the trip if the minimum participants isn’t met. In this case, all payments will be fully refunded, including the deposit. Notification will be provided at least 30 days before the start of the trip.

    2.3 All refunds will be processed back to the original card or payment method used at the time of booking. This process is mandated by card networks and payment providers to ensure secure and traceable transactions. Once a refund has been accepted by the bank or payment provider, Elsewheria has no further control over the release of funds.

    3. What’s Included / Not Included in the Price

    The price of each expedition is the one listed in its respective Program. In any case, the expedition will list everything that is included & excluded in the price.

    Included:

        • The cost of all services listed in the Program (e.g., transportation, accommodation) under the conditions stated

        • Taxes or fees for those included services

      Not Included (unless stated otherwise):

          • Travel Insurance
          • Flights
          • Visas
          • Airport taxes and/or entry and exit fees
          • Vaccination certificates
          • Meals, beverages, and special dietary requirements not listed
          • Laundry and optional hotel services
          • Any on-site purchases not included in the itinerary
          • Tips
          • Optional excursions or visits (prices may vary depending on availability at the destination)

        4. Destination Rules & Assumption of Risk

        4.1 Information About Destination Risks

        Elsewheria offers trips to destinations that are adventurous by nature, often involving remote terrain, contact with the natural environment, situations of political instability, or participation in high-risk activities and adventure sports. These expeditions may carry significant physical and psychological risks, which in many cases are part of what makes the experience appealing.

        While we do our best to inform you of the current safety status and known risks of each destination, including official travel warnings and guidance, it is your responsibility to stay informed and understand the risks involved in traveling to these regions. This includes (but is not limited to) risks such as armed conflict, political unrest, restricted movement, civil disturbances, and environmental hazards.

        4.2 Assumption of Risk & Liability Waiver

        By booking a trip with Elsewheria, whether through direct communication or by completing a checkout via our website, you voluntarily accept all risks associated with the destinations and activities involved. Participation in any trip is at your own risk, and you must declare that you understand and assume all known and unknown dangers related to the expedition.

        You also agree to waive all claims against Elsewheria, its employees, contractors, guides, vendors, or affiliates, for any injury, loss, damage, illness, delay, or death that may occur during or as a result of the trip, even if caused by negligence.

        Any recommendations or guidance provided by Elsewheria are advisory in nature and are not legally binding. We are not liable for any consequences (direct or indirect) resulting from acting on or ignoring those recommendations.

        4.3 Common Risks & Dangers

        By booking an Elsewheria expedition, you acknowledge the potential for serious risk, including (but not limited to):

            • Armed conflict, terrorism, or political unrest

            • Dangerous wildlife, including stings, bites, or attacks

            • Rough terrain and natural hazards (cliffs, rivers, forests, etc.)

            • Slipping, falling, or tripping during hikes or treks

            • Natural disasters: landslides, earthquakes, tsunamis, wildfires, lightning

            • Dangerous weather: storms, heatwaves, hail, extreme cold, or darkness

            • Medical issues: dehydration, heatstroke, illness, sunburn, altitude sickness

            • Water-borne or airborne diseases, including Covid-19

            • Improper or unavailable medical care

            • Equipment failure, delayed or failed rescue attempts

            • Emotional or psychological stress

            • Participant negligence or unsafe behavior

            • Exposure to poisonous plants, allergens, or unknown pathogens

          This list is not exhaustive. Risks may arise that are unpredictable and outside the control of Elsewheria. You agree to travel with full understanding of these dangers and voluntarily accept them as part of the adventure.

          4.4 Modification of Itinerary for Security

          Elsewheria may modify routes or activities to protect the safety of travelers. Changes for safety reasons do not count as a major change to the contract.

          4.5 Safety Rules

          Travelers must:

              • Follow all guide instructions.

              • Not participate in unauthorized activities.

              • Respect the group’s pace and discipline.

              • Be physically and mentally fit.

              • Be responsible for personal safety and respect local customs.

            Failure to comply may result in removal from the activity without refund.

            4.6 Proper Equipment

            Travelers must bring the required equipment as specified by Elsewheria. Failure to comply may result in removal from the activity without refund.

            4.7 Guides and Instructors

            Instructions from guides must be followed at all times. Disrespectful or inappropriate behavior may result in expulsion without refund.

            4.8 Adverse Weather

            Routes may be canceled due to adverse weather at the guide’s discretion. Trips will not be canceled in advance for weather reasons. No refunds or claims apply.

            4.9 Suitable Physical and Mental Condition

            Travelers must disclose any health conditions during booking. Reservations may be declined if physical or mental conditions create risks that Elsewheria cannot accommodate.

            4.9 Liability Waiver

            All tour participants will be required to sign an industry-standard waiver releasing Elsewheria from liability related to any aspect of this trip.

            Waivers are either emailed directly after the booking is placed to eSign. Or, they will be issued on day 1 of the tour at our first team briefing.

            5. Travel Insurance

            We require that all travelers purchase comprehensive travel insurance that covers unforeseen events such as cancellation, medical emergencies, theft, and delays. Elsewheria is not responsible for any expenses or losses that result from your failure to obtain proper insurance.

            6. Fitness to Travel

            By joining an Elsewheria trip, you confirm that you are physically and mentally fit to undertake the activities described in the itinerary. It is your responsibility to disclose any pre-existing medical conditions.

            We reserve the right to remove any participant who, in our opinion, is unfit to complete the expedition or who may jeopardize the safety or enjoyment of others.

            7. Code of Conduct

            Participants are expected to:

                • Respect local customs, laws, and environmental regulations

                • Follow instructions given by guides or Elsewheria representatives

                • Behave respectfully and safely at all times

              Failure to do so may result in expulsion from the trip without refund.

              8. Early Trip Departure Protocol

              In the event that a trip participant needs to leave the planned trip itinerary early due to illness, injury, family emergency, personal reasons, or simply because they want to, etc, then there are a few things to note:

              Should a trip participant choose to leave the planned itinerary early for any reason, from the moment they leave the tour, all expenses from that point onwards are the responsibility of the trip participant. 

              This includes, but is not limited to, hotels/accommodation, transportation, emergency helicopter evacuation, internal flights (even if we have purchased you a flight for the trip you are attending), meals, airport transfer, guide services – everything that is normally covered by Elsewheria during your tour is no longer covered once a trip participant decides to leave.

              Once the decision has been made to leave the tour, the trip participant must sign an “Early Departure Waiver Form” – formerly releasing Elsewheria of any further obligations to fulfil our tour/guide/transport/logistics services.

              That said, in an emergency situation or in case of severe illness, Elsewheria staff will do everything within our means to aid the trip participant until they are in a safe/stable condition. When possible, Elsewheria staff can also help you book new accommodation, flights, transport, etc, but all of these expenses are for the trip participant to pay.

              Point being, our staff will always be available to the best of our ability to facilitate the logistics of your departure, should you choose to leave the trip early.

              9. Media & Promotional Use

              By joining a tour, you agree that any photos or videos taken of you during the expedition may be used by Elsewheria for promotional purposes, unless you request otherwise in writing.

              10. Dispute Resolution

              Any dispute arising under these Terms & Conditions will first be attempted to be resolved through informal discussion. If resolution cannot be reached, the matter will be governed by the laws of the country where Elsewheria is registered and will be handled in local courts.Lorem ipsum dolor sit amet, consectetur adipiscing elit.
